By accessing and using DropFix (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and DropFix.

2. Description of Service

DropFix provides a SaaS platform for churn detection, customer retention intelligence, and automated customer communication tools for solo SaaS founders. The Service includes:

• Behavioral signal detection and monitoring
• AI-powered email draft generation
• Daily digest and weekly summary delivery
• Integration with Stripe, Slack, and other platforms
• User analytics and health scoring
• Team collaboration tools (where applicable)

3. Eligibility and Account Registration

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Service under applicable law
• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• DropFix name, logo, and branding are proprietary to DropFix
• AI-generated content may be used for your own business purposes
• You retain ownership of content you create and upload
• You grant us license to use your content to provide the Service

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and processing of your data as described in the Privacy Policy. We act as a data processor for personal data you provide through the Service.

We are not responsible for the practices of third-party services. Review their terms before connecting.

9. Service Availability and Modifications

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access:

• The Service is provided "as is" and "as available"
• We may modify, suspend, or discontinue any part of the Service
• We may update features, pricing, and functionality from time to time
• We will provide reasonable notice of material changes when possible
• Scheduled maintenance may cause temporary unavailability

10. Disclaimers and Limitation of Liability

Disclaimer: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, DROPFIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless DropFix, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms
• Your misuse of the Service
• Your violation of any third-party rights
• Your unlawful or fraudulent use of the Service

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DropFix operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to binding arbitration or the exclusive jurisdiction of competent courts.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your data after a 30-day grace period following termination
• Any outstanding fees remain payable
• Provisions that by their nature should survive termination shall survive

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on our website
• Updating the "Last updated" date
• Email notification for significant changes (where required)

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

• Waiver: Failure to enforce any provision shall not constitute a waiver
